Domain Registration Agreement

1. OVERVIEW
This Domain Registration Agreement (this “Agreement”) is entered into between you and HKTEKNOLOJIX Bilişim ve Teknoloji Hizmetleri (HKTEKNOLOJIX) and shall be effective as of the date of electronic acceptance. This Agreement sets forth the terms and conditions governing your use of HKTEKNOLOJIX Domain Registration services. The terms “we,” “us,” or “our” refer to HKTEKNOLOJIX. The terms “you,” “your,” “User,” or “Customer” refer to the individual or entity accepting this Agreement. Unless otherwise stated, no provision of this Agreement shall be deemed to confer any rights or benefits on any third party.

By entering into this Agreement, you acknowledge and agree that:
(i) HKTEKNOLOJIX may, at its sole discretion, modify this Agreement and the policies or agreements referenced herein at any time, and such modifications or amendments will become effective upon publication on the Site; and (ii) your continued use of the Site or the Services provided on the Site after such modifications or amendments constitutes your acceptance of the latest version of this Agreement. If you do not agree to be bound by the most recently updated version of this Agreement, you should not use (or continue to use) the Site or the Services provided on it. HKTEKNOLOJIX may also notify you of such changes or amendments to this Agreement via email from time to time. Therefore, it is important that you keep your customer account (“Customer Account”) information, including your email address, up to date. HKTEKNOLOJIX shall not be liable for any failure to receive email notifications due to incorrect or outdated email addresses. HKTEKNOLOJIX is an ICANN (Internet Corporation for Assigned Names and Numbers) accredited domain registrar.

You acknowledge and agree that HKTEKNOLOJIX may amend this Agreement (i) to comply with ICANN and/or (ii) to comply with the registration requirements applicable to the relevant TLD or country code top-level domain (“ccTLD”). The term “Registrar” refers to a service provider responsible for operating and managing registration services on behalf of the Registry for the applicable TLD or ccTLD.

2. SPECIFIC TERMS FOR ALL REGISTRATIONS
Unless otherwise stated, the provisions of Section 2 below apply to all TLDs offered by us. Specific provisions for TLDs or ccTLDs are stated in later sections of this Agreement.

1. Registration Principles. You agree to comply with all Registration Principles applicable to the registration of your domain name (as described in this Agreement above). Notwithstanding any other provision of this Agreement, the Registry for the TLD in which your domain is registered shall be a third-party beneficiary of this Agreement. The parties agree and acknowledge that the Registry has third-party beneficiary rights under this Agreement and that the Registry, as the domain registrar for the relevant TLD, is acting based on such third-party beneficiary rights. These rights shall not be extinguished by termination of this Agreement.

2. Registration Requirements. Where any TLD or ccTLD imposes eligibility (e.g., residency for .JP, .EU, etc.), validation (e.g., DNS verification), or other authentication requirements as conditions for registering a domain name, by submitting an application or registering or renewing your domain:
   (a) you represent and warrant that all information provided for registration or renewal (including all supporting documents, if any) is accurate, complete, not misleading, and submitted in good faith;
   (b) you meet and will continue to meet the eligibility criteria required by the Registration Principles for the relevant TLD during the registration period;
   (c) you have not previously submitted an application to another registrar for this domain using the same eligibility criteria that was rejected (if applicable);
   (d) you acknowledge that even if the domain is accepted for registration, your authority to register the domain may be challenged by others claiming rights to the domain; and
   (e) you accept that if any representation or warranty is found to be false, incomplete, or misleading, the registration or the Registrar may cancel the domain registration.

3. Prohibited Content, Trademark, and Impersonation. You may not host any content on the registered domain that impersonates third parties, infringes trademarks, trade names, or service names, or is misleading, fraudulent, or deceptive. HKTEKNOLOJIX reserves the right to suspend the domain and report to authorities in such cases.

4. Ownership. You acknowledge that registering a domain does not confer any ownership rights to you, the Registrar, or any other person, and entry of a domain into a registrar does not constitute proof of ownership of the domain. You shall not attempt to transfer, pledge, or encumber any ownership rights in the domain.

5. ICANN Requirements. You agree to comply with all ICANN requirements, standards, policies, procedures, and practices applicable to registrars.

6. Indemnification of Registrar. You agree to indemnify and hold harmless the Registry, the Registrar, and its subcontractors, affiliates, partners, officers, directors, employees, agents, insurers, predecessors, successors, and representatives from any claims, liabilities, damages, losses, costs, or expenses, including reasonable legal fees arising from or related to your domain registration, use, renewal, deletion, transfer, or breach of applicable terms. This indemnification survives termination or expiration of this Agreement.

7. Regulated TLDs. Registration in any “Regulated” TLD is subject to additional legal and compliance requirements, including privacy, data collection, consumer protection, credit, debt collection, organic agriculture, data disclosure, and financial reporting.

8. Highly Regulated TLDs. In addition to Regulated TLD requirements, registration in “Highly Regulated” TLDs requires providing information for complaints or misuse reports, possessing necessary licenses or authorizations, and ensuring ongoing compliance.

9. Special Security TLDs. In addition to the above, registration in any “Special Security” TLD must not imply association, sponsorship, or approval by any military or government if none exists.

10. Third-Party Beneficiary. The Registry for the TLD is a third-party beneficiary of this Agreement. Registry third-party rights are not affected by termination of this Agreement.

11. Variable and Non-Uniform Pricing. Certain TLDs may have variable pricing or non-uniform renewal fees.

12. Privacy or Proxy Restrictions. Certain TLDs or jurisdictions may restrict use of privacy or proxy registrations. You must provide accurate information when registering.

3. REGISTRATION AND PAYMENTS
You agree to pay all fees for services purchased or acquired via this Site. HKTEKNOLOJIX reserves the right to change fees and prices at any time, effective immediately upon online posting.

3.1 DOMAIN RENEWAL TERMS
All renewals are subject to this Agreement as amended from time to time. Renewal fees are non-refundable. If HKTEKNOLOJIX cannot charge your registered Payment Method, your domain will expire. Certain ccTLDs require renewal 15 days before expiration. HKTEKNOLOJIX is not liable for failure to renew expired domains within this Agreement.
