Effective Date: October 1, 2025
- Parties
This Agreement is made between Hüseyin KARAGÖZ, located at Orta Yılmazlar Mah. Çamlıca 1. Sokak No:7 D:3 Ünye/ORDU, Türkiye (hereinafter referred to as “HKTeknolojix”), and the real or legal person who wishes to purchase web hosting services from HKTeknolojix (hereinafter referred to as the “CLIENT”).
This Agreement applies solely between HKTeknolojix and the CLIENT and does not cover any third parties. The CLIENT may not transfer, lease, sell, or allow third parties to benefit from the services provided by HKTeknolojix.
- Description of Services
HKTeknolojix provides server hosting services that enable online publishing on the internet. The CLIENT may use this service for website hosting, email services, and similar digital activities.
2.1 Service Components:
- a) Web Space: Disk space allocated to the CLIENT on HKTeknolojix servers.
b) Email Service: Mailboxes assigned to the CLIENT for sending and receiving emails.
c) Internet Traffic: Data transfer and user access through the CLIENT’s hosting account.
d) Access and Publishing Service: Hosting and publication of websites and/or databases.
- Service Continuity and Responsibilities
3.1 Obligations of HKTeknolojix:
- To take necessary technical measures to ensure continuous and secure service delivery.
- To maintain the service level defined within the Service Level Agreement (SLA).
- To manage SSL certificates and related security processes in accordance with security policies.
3.2 Obligations of the CLIENT:
- To use the web space and email service solely for lawful purposes.
- Not to engage in any illegal or contract-violating activities.
- If acting as a reseller, to ensure that their own customers also comply with these rules.
3.3 Force Majeure:
Service interruptions may occur due to force majeure events such as earthquakes, fires, wars, or cyberattacks. HKTeknolojix shall not be held liable for such interruptions.
- Service Limitations
4.1 Physical and Technical Limitations:
- The scope and limits of the service are determined by the package selected by the CLIENT.

4.2 Prohibited Activities:
The CLIENT may not engage in the following activities:
- Hosting or distributing unauthorized software (warez), malware, spam, fake giveaways/gambling, illegal betting, fraud, or deceptive investment systems (e.g., Ponzi, MLM).
- Publishing content that violates copyright laws.
- Hosting or using hacking tools or scripts.
- Broadcasting live copyrighted content (e.g., FIFA, NBA, etc.).
- Selling or distributing products/services without legal authorization.
HKTeknolojix reserves the right to suspend or terminate the service upon detection of such activities. No refund will be provided in such cases.
- Service Fees and Payments
- The CLIENT agrees to pay for the services provided by HKTeknolojix based on the current price list.
- The initial setup and first payment are collected at the time of contract execution.
- If payment is not made upon the renewal date, HKTeknolojix reserves the right to suspend or terminate the service.
- Warranty and Disclaimer of Liability
- HKTeknolojix does not guarantee uninterrupted service operation.
- HKTeknolojix shall not be held liable for any direct or indirect damages, data loss, or commercial loss arising from service interruptions.
- The CLIENT accepts full responsibility for any misuse of allocated resources and agrees to indemnify HKTeknolojix for any damages caused to third parties.
- Data Protection and Privacy
- HKTeknolojix commits to keeping the CLIENT’s personal data confidential and processing it in compliance with the Law No. 6698 on the Protection of Personal Data (KVKK).
- The CLIENT is responsible for complying with KVKK regulations when processing personal data belonging to third parties.
- Term, Termination, and Renewal
- This Agreement enters into force on the date of signature and remains valid for the duration of the selected service period.
- Unless either party provides written notice of termination at least 15 days before the contract expiry date, the Agreement shall automatically renew for another term under the same conditions.
- HKTeknolojix reserves the right to update the terms of this Agreement unilaterally. Any updates shall become effective 10 days after being published on the website. Continued use of the service after this period constitutes acceptance of the changes.
- Dispute Resolution
Any disputes arising from this Agreement shall be governed by the laws of the Republic of Turkey, and Ünye Courts and Enforcement Offices shall have exclusive jurisdiction.
- Enforcement
This Agreement, consisting of 10 main sections and 20 articles, has been prepared in two copies and entered into force upon signature by both parties. The parties acknowledge that they have read, understood, and accepted all provisions of this Agreement.
